Terms and Conditions
Effective date: October 15, 2026 · Version 2026-10-15
These Terms and Conditions govern djboothpro.com and app.djboothpro.com, DJ Booth PRO, DJ Booth LITE, SpinList, Booth Brawl, AppReleaser Pro, and other applications we distribute with a link to these Terms, on supported desktop, mobile and browser platforms. They also cover connected accounts, digital and vinyl stores, artist and seller tools, downloads, licenses, skins, avatar and content packs, community features, leaderboards, streaming integrations, and support (collectively, the “Services”). Only features actually offered for your product, platform and region are included; describing a feature here does not promise its availability. The Services are operated by DJ Booth PRO, a fictitious name of TOMMYWHO RECORDS, INC. (“DJ Booth PRO,” “we,” “us,” or “our”).
When completing account setup, you must affirmatively agree to these Terms and acknowledge our Privacy Policy. We record the account, acceptance date and document versions. Privacy acknowledgment is not consent to marketing, optional tracking or every type of data processing. Separate permissions or consent are requested where required. If you do not agree, do not complete account setup; you may contact us about existing purchases or privacy rights.
PRODUCTS, PLATFORMS AND OPTIONAL FEATURES
DJ Booth PRO and LITE provide playback and mixing tools; capabilities, activation rules and compatible formats differ by edition and platform. SpinList provides record identification, catalog editing, listing and seller tools. Booth Brawl provides interactive avatars and stream participation. AppReleaser Pro provides release-management tools; publishing requires your own appropriate accounts, permissions and signing credentials. Product-specific purchase disclosures and applicable app-store license terms continue to apply. The two-computer PRO activation rule below does not automatically apply to other products.
DIGITAL MUSIC, SKINS AND CONTENT PACKS
Digital music, skins, avatars and other packs may require a compatible app version and an eligible account or license. Buying a recording, visual or pack does not transfer copyright or grant public-performance, broadcast, synchronization or redistribution rights. Importing an external pack does not make its content authorized. You are responsible for permissions to use third-party music, characters, logos, photographs and other protected material. Keep your own permitted backups; previews and metadata are informational and may not precisely match the purchased release.
VINYL STORE AND SPINLIST SELLERS
Physical records are sold according to the listing, condition, quantity, price, shipping and seller information shown at checkout. Sellers must have the right to sell the records, provide accurate listings, maintain available inventory and fulfill accepted orders. Buyers and sellers should promptly report missing, damaged, incorrect or unavailable items to info@djboothpro.com with the order number. Item substitutions require the customer's agreement and should be recorded against the original order. Digital-delivery refund restrictions do not automatically apply to physical records; applicable law and the terms disclosed for the physical purchase govern.
Seller earnings and amounts paid are different. Reports may show record sales, shipping collected, refunds, merchant processing fees, disclosed SpinList fees and the resulting seller earnings. Current vinyl calculations deduct a $1 SpinList fee per originally sold record and the merchant processing fee from record revenue; shipping collected is retained by SpinList for shipping, handling and any remaining margin. Any change to these fees must be disclosed before it applies to future sales. Payment processing fees depend on the provider and transaction. Estimates or pending fees are not final settlement amounts. Earnings shown in a report do not by themselves confirm that a payout has been sent. Payout history records completed payments and available transaction references or receipts. Available payout methods, timing and verification requirements are communicated separately; this document does not promise immediate or automatic payouts.
RECORD IDENTIFICATION AND MEDIA SAMPLES
Discogs and other third-party catalog information, artwork, tracklists and linked video samples can be incomplete or mismatched. Sellers must check the actual release, catalog number, condition and inventory before publishing. Embedded YouTube samples and external links remain subject to their providers' availability and terms. We do not guarantee that automated identification, genre, BPM, key or other analysis is accurate.
SUPPORT, CONNECTED ACCOUNTS AND ACCOUNT DELETION
You may contact support and submit optional screenshots. Do not include passwords, payment-card details or unnecessary personal information. Response times vary. Connected streaming, commerce, shipping and payout services require appropriate authorization and remain subject to their own rules. You may request account deletion through the available deletion flow or info@djboothpro.com; we may retain records needed for completed orders, licensing, disputes, fraud prevention or law. Deletion does not itself cancel a subscription billed by a separate app store or provider; manage that subscription with the provider.
ELIGIBILITY AND ACCOUNTS
You must be legally able to enter into a binding agreement. If you are under the age of majority where you live, a parent or legal guardian must approve your use and purchases.
You are responsible for the accuracy of your account information, the security of your password and license key, and all activity under your account. You may not sell, transfer, share, impersonate another person through, or create fraudulent accounts. Notify us promptly at info@djboothpro.com if you suspect unauthorized access.
FOUNDING BETA MEMBER PRE-ORDERS
DJ Booth PRO may offer a limited Founding Beta Member Pre-Order before the software is ready for distribution.
• A pre-order is a reservation for future beta access and the corresponding release license; it is not an immediate software download. • Software access and license keys will be delivered when beta distribution begins for the applicable customer group. • Estimated features, appearance, compatibility, system requirements, schedules, and release dates may change during development. • Beta software may contain bugs, incomplete functions, performance issues, or changes that affect saved settings and content. • “First 100 Founding Beta Members” refers to the first 100 qualifying, completed, non-refunded pre-orders recorded by our order system. • Founding recognition has no cash value and cannot be transferred between accounts. • Beta participants may be invited to provide feedback, but we do not guarantee that any suggestion will be implemented.
You may request cancellation and a full refund before beta software or a license key is delivered to your account. After digital access or a license key has been delivered, purchases are non-refundable except where required by law or expressly approved by us. To request cancellation, contact info@djboothpro.com with your order information.
If we permanently cancel the product before beta distribution begins, we will refund affected pre-orders.
PURCHASES, PRICES, TAXES, AND DIGITAL DELIVERY
Prices and availability may change at any time before an order is completed. Applicable taxes and payment-processing details are shown at checkout. Payments are processed by Wix and the payment provider selected at checkout; we do not receive your complete payment-card number.
Digital products may include software, license entitlements, skins, downloadable music, playlist packs, or other content. Delivery may occur through your member account, email, a download link, or synchronization inside DJ Booth PRO. You are responsible for maintaining a compatible device, internet access when required, and backups of downloaded content.
Unless a product page states otherwise, digital purchases are licensed, not sold. Download links and account entitlements are personal and may not be resold, publicly posted, or shared.
SOFTWARE LICENSE AND ACTIVATION
When we deliver DJ Booth PRO, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use it according to the product description and these Terms.
Unless stated otherwise, one DJ Booth PRO license may be activated on up to two computers controlled by the purchaser. You may not share, sell, rent, sublicense, publish, or distribute your license key; bypass activation, copy protection, tier restrictions, purchase verification, or account controls; reverse engineer, decompile, extract, or modify protected portions except where applicable law expressly permits it; infringe the rights of others; or use unauthorized automation, falsified data, exploits, or interference to manipulate points, achievements, unlocks, rankings, or leaderboards.
We may suspend a compromised key and provide a replacement after verifying the purchase. Software updates may be required for security, compatibility, licensing, marketplace synchronization, or leaderboard participation.
MUSIC, VIDEO, TWITCH, YOUTUBE, AND THIRD-PARTY SERVICES
You are responsible for having all rights and permissions needed for music, samples, artwork, video, streams, broadcasts, uploads, and other content you use with DJ Booth PRO. Owning the software does not grant music, synchronization, public-performance, broadcast, or platform rights.
Twitch, YouTube, Wix, MIDI hardware, payment providers, and other third-party products and services have their own terms and privacy practices. Their availability, APIs, policies, advertising, content, and functionality are outside our control. DJ Booth PRO is not responsible for third-party interruptions, takedowns, account actions, or policy changes.
PROFILES, VIP BADGES, LEADERBOARDS, AND FAIR PLAY
If you participate in community features, certain profile and performance information may be visible to other users, including your display name, profile image, VIP Badge, skill tier, rank, achievements, and Perfect Mix Points.
Points and rankings are for entertainment, recognition, and skill development. They have no cash value and do not establish employment, professional certification, or eligibility for a prize unless separate official contest rules expressly say so.
We may correct scores, reject suspicious events, remove fraudulent activity, disqualify accounts, or reset leaderboards to protect fair play. Changing skill levels immediately before a scored event, altering local data, replaying falsified events, manipulating timing or metadata, or using unauthorized tools to obtain points is prohibited.
USER SUBMISSIONS AND FEEDBACK
You retain ownership of content you submit. You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, format, display, and transmit that content only as needed to operate, promote, secure, and improve the Services.
If you voluntarily submit product ideas or feedback, you allow us to use them without restriction or payment. Do not submit confidential material that you do not want used for product development.
Artist publishing is subject to account eligibility, any required approval, and the separate Artist Agreement. Submission does not guarantee approval, publication, promotion, or continued availability. Separate creator or marketplace terms may apply before content is accepted for sale.
INTELLECTUAL PROPERTY
DJ Booth PRO, its software, interface, visual designs, Perfect Mix system, text, graphics, logos, trademarks, and original content are owned by or licensed to TOMMYWHO RECORDS, INC. These Terms do not transfer ownership to you.
You may not copy the website, software, branded assets, skin designs, documentation, or marketing materials except as expressly permitted in writing or as necessary for ordinary licensed use.
ACCEPTABLE USE AND ENFORCEMENT
You may not use the Services to commit unlawful acts; distribute malware; harass others; collect personal information without permission; disrupt servers or networks; test vulnerabilities without authorization; or evade security, payment, account, or moderation controls.
We may investigate violations and suspend or terminate access when reasonably necessary to protect users, intellectual property, security, payment integrity, fair play, or legal compliance. Where practical, we will provide notice and an opportunity to contact support.
BETA STATUS, DISCLAIMERS, AND AVAILABILITY
Pre-release and beta Services are provided for testing and evaluation. To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of uninterrupted operation, error-free performance, fitness for a particular purpose, merchantability, or non-infringement.
DJ Booth PRO is a performance tool, not a guarantee of streaming income, audience growth, leaderboard position, professional work, compatibility with every controller, or uninterrupted third-party service access.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, TOMMYWHO RECORDS, INC. and its officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits or revenue; lost broadcasts; corrupted files; lost content; third-party account actions; or loss of goodwill arising from the Services.
To the fullest extent permitted by law, our total liability for a claim will not exceed the amount you paid us for the product or service giving rise to that claim during the twelve months before the event. These limitations do not apply where prohibited by law.
INDEMNIFICATION
To the extent permitted by law, you agree to defend and indemnify TOMMYWHO RECORDS, INC. from third-party claims arising from your unlawful use of the Services, your content, your infringement of another party’s rights, or your material violation of these Terms.
CHANGES TO THE SERVICES OR THESE TERMS
We may update the Services and these Terms as the product develops. Material changes will be posted with a revised effective date and, when appropriate, communicated through the website, member account, software, or email. Changes do not retroactively remove rights already required by law.
TERMINATION
You may stop using the Services at any time. We may terminate or restrict access for a material violation of these Terms, fraud, chargeback abuse, security threats, or unlawful conduct. Sections that reasonably should survive termination—including ownership, licenses already granted, disclaimers, liability limits, and dispute provisions—will survive.
GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute not resolved informally will be brought in a court of competent jurisdiction in Florida, unless applicable consumer law gives you the right to bring a claim elsewhere.
Before filing a claim, please contact info@djboothpro.com so we can attempt to resolve the issue.
GENERAL TERMS
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your account or license without our written consent. We may assign these Terms as part of a merger, reorganization, financing, or transfer of the Services. These Terms, the Privacy Policy, product-page disclosures, and any applicable marketplace or promotion rules form the entire agreement concerning the Services.
